I never thought this would be an area of expertise for me but it has become exactly that. Seeing my parents have the worst messy divorce possible has allowed me to help many of my clients make the split amicable from day one. I remain a believer in the importance a great partner in life and always hope for the best when any of my clients find their life partner.
Too often, when a couple is a buying a home....they forget that its a BUSINESS decision. Although the plan is to have a life together and raise kids....you would never buy a home knowing you will lose money when you sell it. I prefer to explain this to many couples in a way that lets them know that IF this is done correctly, both parties are able to move on with great success VS paying a lawyer by the hour to settle issues for them.
If they mutually agree on selling the home or condo BEFORE they meet with a lawyer....very often, they are miles ahead of the game. This is often the minority of couples. The best example of late is where the kids college fund is put into a trust account BEFORE any legal fees are incurred. It also presents a unified front that a potential buyer will not be able to take advantage of. As recently as last week, I was able to get a realtor to tell me that a couple was divorcing. Not something I should be able to find out if my clients are in buying mode so having the right representation IS key. Not just the realtor who sold you the house or the "friend" with a license.
